A Lasting Power of Attorney, or LPA, is a legal document that allows you to appoint one or more people you trust to make decisions on your behalf if you are ever unable to do so yourself.
There are two types of LPA. One covers Property and Financial Affairs, including bank accounts, bills, property and investments. The other covers Health and Welfare, including care decisions and medical treatment.
A Property and Financial Affairs LPA can be used once it has been registered with the Office of the Public Guardian, either while you still have mental capacity if you choose, or later if you lose capacity.
A Health and Welfare LPA can only be used if you are no longer able to make those decisions for yourself.
You do not have to use a solicitor, but mistakes in the form or signing process can cause delays or rejection. Many people use a solicitor to make sure the document is prepared properly and reflects their wishes clearly.
